This Privacy Policy (“Privacy Policy”) sets out how we collect, use and disclose your data when you use a mobile application called ‘Chatex’ (“App”). The Website and App are collectively referred to as the “Platform”. References to “we”, “our” or “us” or the “Company” shall mean the Platform and/or Chargeatsk Digital Pvt. Ltd. Any references to “you”, “your” or “user” shall mean any person or entity using our Platform. We will not use or share your information with anyone except as described in this Privacy Policy.

By using this Platform, you agree to the terms and conditions of this Privacy Policy. You also consent to our use and disclosure of your Personal Information (as defined below) in the manner described in this Privacy Policy.

Content Visible to Others

Any content you post on your profile or others’ profiles, such as comments or posts, is publicly accessible, including by search engines. Information you voluntarily share on the Platform, including on your profile, can be seen by anyone. Content you make public may be reshared by others, both on and off the Platform. Be mindful of who you share with, as they can further distribute it beyond your intended audience. For instance, if you send a post or message to specific users, they may download or share that content elsewhere. Likewise, your likes or comments on others’ posts are visible to anyone who can view that content. Additionally, other users may create and share content about you, such as tagging you in a post or uploading a photo of you.

 

We reserve the right to share all public content on any social media platform or other online/offline platforms. However, we will not rent or sell your personal information to third parties, except in anonymized formats, unless explicitly stated in these terms.

 

Sharing with Our Group of Companies

We may share your personal information with any entity within our corporate group. "Group" refers to any entity that we control, that controls us, or that is under common control with us.

 

What You Share with Others

When using the Platform to share content, you control the audience. For example, when you post from the Platform on Facebook, you decide whether to share with all friends, certain friends, or a specific group. Similarly, when sharing via apps like WhatsApp, you control who sees your content. We are not responsible for how those individuals use the content you share with them via third-party platforms like WhatsApp or Facebook.

 

Sharing with Third Parties

We may share your personal information with select third parties, including:

 

- **Business Partners, Suppliers, and Subcontractors (Affiliates):** They may use your information to assist in providing, understanding, and improving services as part of any contract we enter with you.

- **Advertisers and Advertising Networks:** While we don’t disclose identifiable personal data to advertisers, we may share aggregated data to help them target ads. For example, we may tell advertisers how many users in a particular age group clicked on their ads.

- **Service Providers:** We use third-party service providers for tasks like data hosting, maintenance, analytics, marketing, customer care, payment processing, and security.

 

We may also share your information with government bodies or law enforcement when necessary for legal compliance, protecting public safety, or addressing fraud, security, or technical concerns.

 

In the event the Company undergoes a merger, acquisition, or asset sale, your personal information may be transferred to the acquiring entity. If this occurs, you will be notified in advance and can opt out by deleting your account.

 

 Third-Party Stores, Premium Services, and In-App Purchases

We may offer certain paid products or services, including virtual goods, premium features, and in-app products. These purchases may be made through third-party stores (e.g., Google Play). By using these services, you agree to additional terms that apply to these purchases.

 

Purchases are processed via your chosen payment method, such as a credit card or third-party payment processor. All payments are non-refundable. If your payment fails, you must promptly provide an alternative payment method. We are not responsible for issues arising from third-party payment platforms, including any errors in payment processing or product descriptions. Furthermore, we reserve the right to modify product offerings, promotional terms, or restrict transactions at any time.

 

If your account is terminated for violating the terms, you are not entitled to a refund for any unused services or purchases. We encourage you to review the terms of third-party platforms before making purchases.


 

Coins Purchase and Refund Policy

  • You can now licence virtual gifts or digital goods (such as stickers, gifs, banners, etc.) to other users on our Platform ("Gifts"). These Gifts can be sent by acquiring Coins ("Coins/Coin") through our authorised payment methods and providers. Please note that Coins and Gifts cannot be exchanged for cash or any form of legal tender.

Purchasing Coins

  • The price for Coins will be displayed at the point of purchase. All charges and payments for Coins will be made in the currency specified at purchase, through the payment mechanisms we provide. You are responsible for paying for any Coins you purchase, and once the payment is complete, the corresponding number of Coins will be credited to your account.
  • **Please note:** Once Coins or any service is purchased on the Platform, they are non-refundable in any manner.

Usage of Coins

  • Coins can be used to purchase virtual items, such as gifts, vew premium content, or make audio & video calls, or online chat with users. Coins cannot be exchanged for cash, legal tender, or any currency recognized by a state, region, political entity, or other forms of credit.
  • Coins are exclusively for use on our Platform and cannot be combined with other promotions, coupons, discounts, or special offers unless explicitly designated by us. Coins may not be transferred, sold, or assigned to any other user or third party. Any attempt to sell, trade, or transfer Coins in violation of this policy may result in the termination of your account, forfeiture of Coins, and potential legal action.
  • Coins are not considered property and cannot be transferred: (i) upon death; (ii) as part of a domestic relations matter; or (iii) by operation of law. 
  • We reserve the right to manage, regulate, control, modify, or eliminate Coins, especially if we reasonably believe you have violated this Coins Policy, applicable law, or for legal, security, or technical reasons. If we choose to discontinue Coins entirely, we will provide reasonable notice.

Purchasing Gifts

  • Gifts represent a limited licence to access certain digital products or services. The conversion or redemption rate between Coins and Gifts will be displayed on the Platform. Prices shown will include any applicable taxes based on your jurisdiction.
  • We reserve the right to regulate, control, modify, or eliminate the conversion rate between Coins and Gifts at our sole discretion, without liability to you.
  • **All conversions and redemptions of Coins into Gifts are final.** Gifts cannot be refunded, converted back into Coins, or exchanged for cash.
  • Gifts, once exchanged or received, do not constitute property and cannot be transferred: (i) upon death; (ii) as part of a domestic relations matter; or (iii) by operation of law. 
  • In cases where Gifts are corrupted or damaged, we may replace them at our discretion without additional fees.
  • We reserve the right to take action, including account termination, if we determine you are abusing the Coins feature or violating this Coins Policy.
  • **Important:** You are not permitted to use Coins or Gifts as a form of payment for goods or services from any user on or off the Platform.

**Note to Users**

 

Coins and Gifts on our Platform are not treated as individual goods but as licensed access to specific items. All Coins and Gifts associated with your account will be forfeited once you delete your account. Coins cannot be traded on the internet.

 

You are solely responsible for the Coins and Gifts you purchase, and we are not liable for any issues related to them. We reserve the right to determine, at our sole discretion, what constitutes a violation of our policies.

 

We also reserve the right to modify portions of this Coins Policy at any time. Any changes will be posted on this page, with the date of the latest update clearly indicated at the top.

**Security Practices**

We implement appropriate technical and security measures to safeguard the information we collect. If you have been provided with a username and password (or have created them), you are responsible for keeping these details confidential. Please avoid sharing your password with anyone.

**Where We Store Your Personal Information**

We store your data using Contabo Servers and Google Cloud Platform (GCP), with servers located both in India and internationally. **Changes to This Policy**

We may update this Privacy Policy from time to time. Any changes that are important for you will be posted at this link. It is your responsibility to review this page regularly for any updates.

**Disclaimer**

Please note that transmitting information over the internet is not completely secure. While we strive to protect your Personal Information, we cannot guarantee its security during transmission to our Platform. Once we receive your data, we use strict security measures to prevent unauthorised access.

**Your Rights**

You may delete content from your account at any time. However, a record of your activity may still be available to us. You may also correct, amend, or delete Personal Information from your profile, and opt out of unwanted emails by following instructions in the messages.

Under Section 5(6) of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, you have the right to ask us to review, correct, or amend the information we collect about you. You can also revoke consent for data collection going forward, though this may affect your use of the Platform. For instance, without access to your device’s media folder, you will not be able to upload photos. **Data Retention**

We do not retain your Sensitive Personal Information (such as passwords) longer than necessary for lawful purposes. We may keep copies of public content indefinitely in our system, including cached or archived pages, or if other users have saved or copied such content. As the internet is inherently persistent, your deleted content may still be available elsewhere.

The Platform may contain links to third-party websites, such as partners or advertisers. These sites have their own privacy policies, and we do not accept responsibility for how they handle your data. Please review their policies before submitting personal information.

 

**Third-Party Embeds**

Some content on the Platform (e.g., YouTube videos, SoundCloud audio, etc.) may be hosted by third-party services.
